Upon full payment of all applicable fees, you own the content and creative materials we produce specifically for your business (website copy, custom graphics, etc.). 49 Marketing retains ownership of its proprietary tools, templates, processes, and methodologies used to deliver services.
You grant 49 Marketing a non-exclusive license to use your business name, logo, and website for portfolio and case study purposes unless you request otherwise in writing.
Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of the service relationship. We will not disclose your business strategies, customer data, or financial information to third parties without your consent, except as required by law.
While we work diligently to deliver results, we cannot guarantee specific outcomes such as rankings, traffic levels, or revenue increases. SEO and digital marketing results depend on many factors outside our control, including search engine algorithm changes, market competition, and industry conditions. Any examples or statistics referenced on our website are illustrative and not a guarantee of future performance.
To the fullest extent permitted by law, 49 Marketing shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including loss of revenue, data, or business opportunities. Our total liability in any matter related to our services shall not exceed the total amount paid by you in the three months preceding the claim.
We strive to maintain high availability of all managed websites and services. However, we do not guarantee uninterrupted service. Scheduled maintenance, third-party outages, or circumstances beyond our control may result in temporary service interruptions. We will make reasonable efforts to notify clients of planned downtime in advance.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of California.
We reserve the right to update these Terms of Service at any time. We will notify active clients of material changes via email with at least 14 days' notice. Continued use of our services after the effective date of changes constitutes acceptance of the updated terms.
